I don't see it that way.

To date, the council had said that the ban will stay in place during
the legal process.

With that concluded, I guess that it was unlikely that they would just
reverse the ban, but from my reading of the BBC article, the door is
now open for the local buggiers to get together and demonstrate to the
council a responsible attitude, accountability and insurance cover
backed by a risk assessment.

This is a fairly well trodden path. The council need to be able to
show that they are making a considered and informed decision. I don't
see anything in the article that should stand in the way of them doing
this but it will require considerable effort from the local buggiers.

I would see this as the next stage in the process, not a setback at
all.
